1. OBJET ET IDENTIFICATION

2. CHAMP D’APPLICATION

2.1. TERMINOLOGIE

Le Participant désigne toute personne physique participant en son nom propre ou pour le compte d’une personne morale (entreprise, laboratoire, société, industriel…) à un évènement organisé par ou avec l’appui logistique de UL PROPULS. Le participant est amené à assister aux conférences (physiques ou virtuelles), à participer aux différentes animations du programme scientifique et social, mais également à intervenir dans le cadre de communication orale ou poster selon le programme scientifique retenu.

L’Exposant désigne toute personne physique participant pour le compte d’une personne morale (entreprise, laboratoire, société, industriel…) en tant que partie prenante à un évènement organisé par ou avec l’appui logistique de UL PROPULS. Les modalités de cette participation sont détaillées dans un dossier de partenariat. Pour plus de lisibilité et quel que soit le type d’offre retenue (soutien financier, partenaire, sponsors, subvention, exposant…) le terme générique Exposant sera retenu dans les présentes conditions générales de ventes.

L’Evènement désigne toute manifestation organisée par ou avec l’appui logistique de UL PROPULS. Ces évènements peuvent prendre différentes formes : séminaire, journée technique, école d’été, congrès, workshop, table ronde, assemblée générale etc… Un Évènement peut avoir lieu de façon physique, hybride (physique et virtuelle), ou virtuelle uniquement.

2.2. CHAMP D’APPLICATION

Les présentes conditions générales de vente s’appliquent, à l’exclusion de toute autre disposition, à toute inscription d’un ou plusieurs Participants, à un Evénement organisé par UL PROPULS, ci-après dénommé le « Participant », ou à toute participation d’un industriel ou Exposant sous forme de partenariat, ci-après « l’Exposant ».

1. 1. Le fait de s’enregistrer à un Evénement en ligne implique une acceptation sans réserve, et dans leur intégralité, des présentes conditions générales de vente.30
  2. UL PROPULS se réserve le droit de modifier les termes des présentes conditions. Seules les conditions générales de vente en vigueur au jour de l’enregistrement s’appliqueront à l’inscription concernée.

3. INSCRIPTION

3.1 POUR LES PARTICIPANTS

L’enregistrement en tant que Participant est possible en complétant le formulaire directement en ligne sur le site de l’Evènement.

3.2 POUR LES EXPOSANTS

L’enregistrement en tant qu’Exposant est possible en complétant le formulaire directement en ligne sur le site de l’Evènement, ou en retournant le bon de réservation par mail à l’adresse mail générique du congrès ou à events[@]ul-propuls.fr.

3.3 INSCRIPTIONS TARDIVES

Une inscription est considérée comme tardive lorsqu’elle intervient moins de 14 jours calendaires avant l’Evènement pour un Participant et moins de 45 jours calendaires avant l’Evènement pour un Exposant. Des conditions de règlement particulières s’appliquent, elles sont décrites ci-après dans l’article 4.5 Règlement des inscriptions tardives.

4. MODALITES DE PAIEMENT

4.1 POUR LES PARTICIPANTS

Le règlement intégral des frais d’inscription des Participants est à effectuer auprès de UL PROPULS, comptant, sans escompte. Toute inscription pour laquelle le dossier serait incomplet ou non accompagné de son règlement dans les conditions précisées ci-après, ne sera pas prise en compte.

4.2 POUR LES EXPOSANTS

Le règlement intégral des frais de participation en tant qu’Exposant est à effectuer auprès de UL PROPULS, comptant, sans escompte. Toute inscription pour laquelle le dossier serait incomplet ou non accompagné de son règlement dans les conditions précisées ci-après, ne sera pas prise en compte. Le partenariat, quelle que soit sa nature, n’est confirmé qu’à réception du paiement de l’Exposant par UL PROPULS. Aucune des contreparties proposées (publication du logo par exemple) ne sera assurée tant que le règlement total n’aura pas été effectué.

4.3 DELAI DE PAIEMENT

Les règlements doivent se faire au plus tard :

- - 14 jours calendaires avant l’évènement pour un Participant
  - 45 jours calendaires avant l’évènement pour un Exposant

4.4. MODES DE PAIEMENT

Le règlement pourra s’effectuer par :

- - Bon de commande

Pour procéder au règlement par bon de commande, merci d’adresser le bon de commande mentionnant le nom de l’Evènement concerné, le nom du Participant ou de l’Exposant, la référence de la commande ou de la facture, le montant à régler, et l’adresse complète de facturation ainsi que le numéro de TVA (le cas échéant) à :

- - Virement bancaire

Pour procéder au règlement par virement, merci de spécifier le nom de l’Evènement concerné, le nom du Participant ou de l’Exposant, la référence de la commande ou de la facture dans les références bancaires. Veuillez noter que les frais bancaires sont à la charge de l’émetteur : veuillez-vous assurer que le paiement inclut tous les frais, y compris les frais de gestion de la banque de réception (« l’expéditeur règle tous les frais”)

Pour procéder au règlement par chèque, veuillez libeller votre chèque à l’ordre de UL PROPULS, en mentionnant au dos le nom de l’Evènement concerné, le nom du Participant ou de l’Exposant, la référence de la commande ou de la facture, adresser à :

- - Carte bancaire, paiement sécurisé en ligne

Pour procéder au règlement par carte bancaire, il vous suffit de suivre les instructions en ligne. Si le mode de paiement par carte bancaire n’a pas été choisi initialement, il ne vous sera pas possible de procéder au règlement par ce moyen de paiement.

Un seul mode de paiement est autorisé par inscription.

Une fois réglé, le prix ne peut faire l’objet d’un remboursement que dans les cas prévus aux articles 9, 10, 11 et 12 des présentes.

4.5 INSCRIPTIONS TARDIVES

Le règlement d’une inscription tardive doit parvenir sur le compte de UL PROPULS (paiement par carte bancaire, virement, ou bon de commande) dans les 7 jours ouvrés suivant la réception par UL PROPULS de l’inscription.

5. VALIDATION DES INSCRIPTIONS

Une fois l’inscription effectuée par le Participant, UL PROPULS lui adressera un récapitulatif valant validation de son inscription à l’Evénement choisi (la « Confirmation d’inscription »).

Le contrat est considéré comme définitivement conclu, à l’envoi par UL PROPULS de la Confirmation de paiement, sous réserve du bon encaissement du règlement.

6. TARIFS

Les tarifs s’entendent par Participant et/ou par Exposant, toutes taxes comprises (TTC). UL PROPULS se réserve le droit de modifier ses prix à tout moment. Les produits seront facturés sur la base des tarifs en vigueur au moment de l’enregistrement de la commande (tarifs figurant sur le site au moment de l’inscription ou dans le dossier papier d’inscription reçu par le Participant). Ils incluent l’ensemble des prestations décrites sur le site d’inscription et/ou le site du congrès pour le tarif correspondant.

7. MODIFICATION DU PROGRAMME DE L’EVENEMENT

En cas de nécessité, et notamment en cas de modifications mineures dans le programme de l’évènement (absence de l’un des intervenants, remplacement de l’un des intervenants invités, modifications d’horaires…), UL PROPULS se réserve le droit de modifier le programme de l’Evènement, sans que cette décision ne puisse ouvrir un droit à remboursement ou à une quelconque réparation pour le Participant ou l’Exposant.

8. DISPONIBILITE

UL PROPULS se réserve le droit de refuser à un Participant son inscription à l’Evènement ou à l’une de ses options (soirée, visite, déjeuners…) si les capacités d’accueil prévues initialement ou modifiées par décision de l’autorité publique sont dépassées.

De même, UL PROPULS se réserve le droit de refuser à un Exposant sa participation à l’Evènement si les capacités d’accueil prévues initialement ou modifiées par décision de l’autorité publique sont dépassées. Ce droit s’applique également en cas d’indisponibilité des prestations proposées (notamment en cas d‘exclusivité sur certaines offres de partenariat).

En cas de paiement mais d’indisponibilité de place, UL PROPULS en informera le Participant ou l’Exposant et lui remboursera le prix de l’inscription sans retenue selon les modalités de remboursements décrites dans l’article 13.

9. RETRACTATION

La personne ou société inscrite en tant que Participant ou Exposant dispose d’un droit de rétractation qu’il peut exercer dans un délai de 14 jours calendaires, à compter de son inscription en ligne, sans avoir à justifier d’un motif. Le Participant ou l’Exposant qui souhaite user de ce droit de rétractation doit le notifier, dans les délais légaux indiqués ci-dessus, en renvoyant le formulaire type joint en fin du présent article à l’adresse suivante : UL PROPULS, 34, cours Léopold – 54000 NANCY France, ou par mail à events[@]ul-propuls.fr. A réception de ce formulaire, UL PROPULS procédera au remboursement selon les modalités décrites dans l’article 13.

Dans le cas où le délai de rétractation de 14 jours, évoqué ci-dessus est expiré, et que le Participant souhaite annuler sa participation à l’Evènement, il devra en informer UL PROPULS par e-mail.

UL PROPULS procédera au remboursement éventuel selon les conditions précisées dans les articles 10 et 13.

Formulaire type de rétractation

Je vous notifie par la présente ma volonté d’exercer mon droit de rétraction concernant l’inscription en ligne suivante :

La confirmation d’inscription et la facture, ainsi qu’un RIB sont à joindre à la demande de rétractation pour effectuer le remboursement des frais d’inscriptions, selon les modalités définies à l’article 13.

10. ANNULATION DU PARTICIPANT OU DE L’EXPOSANT

Toute annulation doit être notifiée par écrit (par courrier ou par mail), les frais d’annulation sont assujettis aux conditions suivantes :

Annulation d’une inscription à l’Evènement par le Participant

- - Annulation jusqu’à 45 jours calendaires avant l’événement: remboursement complet, déduction faite de frais de dossier de 50€.
  - Annulation entre J-45 et J-22 jours calendaires avant l’événement: remboursement de 50% du montant de l’inscription payée, avec une déduction minimale de 50€.
  - Annulation inférieure à J-21 jours calendaires avant l’événement : aucun remboursement possible, hors délais de rétractation légal de 14 jours conformément à l’article 9.

Annulation d’une inscription à l’Evènement par l’Exposant :

- - Annulation jusqu’à 10 semaines calendaires avant l’événement: remboursement à hauteur de 30% du montant total de la commande.
  - Annulation inférieure à 10 semaines calendaires : aucun remboursement possible.

Annulation d’une inscription au programme social ou accompagnant par le Participant :

- - Annulation jusqu’à J-15 jours calendaires : remboursement total de la commande.
  - Annulation inférieure à J-14 jours calendaires avant l’événement : aucun remboursement possible, hors délais de rétractation légal de 14 jours conformément à l’article 9.

Si les conditions pour le remboursement sont remplies, UL PROPULS remboursera le montant dû selon les modalités décrites à l’article 13.

11. ANNULATION OU REPORT DE L’EVENEMENT

11.1 ANNULATION

Si UL PROPULS se voit contraint d’annuler l’Evènement pour des raisons autres que des événements de force majeure* ou indépendants de sa volonté, il s’engage à en prévenir les Participants et Exposants dans les meilleurs délais. Ces derniers se verront alors rembourser leurs frais d’inscription dans leur intégralité, à l’exclusion de tous autres frais (hébergement, transport ou autres) selon les modalités de remboursement décrites dans l’article 13.

11.2 REPORT

Si UL PROPULS se voit contraint de reporter l’Evènement pour raisons autres que des événements de force majeure* ou indépendants de sa volonté, il s’engage à en prévenir les Participants et Exposants et Accompagnants dans les meilleurs délais.

Les inscriptions des Participants et Exposants sont par défaut maintenues automatiquement pour la prochaine édition.

Sur demande par e-mail, les Participants peuvent annuler leur participation et à ce moment-là les conditions générales de vente présentées à l’article 10 s’appliquent.

* Evénements de force majeure : il y a force majeure en matière contractuelle lorsqu’un évènement échappant au contrôle du débiteur, qui ne pouvait être raisonnablement prévu lors de la conclusion du contrat et dont les effets ne peuvent être évités par des mesures appropriées, empêche l’exécution de son obligation par le débiteur : imprévisibilité, irrésistibilité et extériorité. Par exemple : catastrophes naturelles (tempête, ouragan…), évènements politiques (coup d’état, guerre…), incendies).

12. CAS DE FORCE MAJEURE

La responsabilité de UL PROPULS ne pourra être engagée et aucun remboursement des frais d’inscription ou de tous autres frais (hébergement, transport ou autres) ne sera dû, si l’Evènement est reporté ou annulé en raison d’un Evènement de force majeure* au sens de l’article 1218 du Code civil et de la jurisprudence, ou indépendant de sa volonté.

13. MODALITES DE REMBOURSEMENT

1. UL PROPULS procèdera au remboursement partiel ou total des inscriptions décrit dans les présentes conditions générales de vente dans un délai de 14 jours calendaires à réception des éléments lui permettant d’effectuer le remboursement.
2. Si le paiement de l’inscription a été effectué par carte bancaire, le remboursement se fera en créditant cette carte bancaire et sous réserve que la carte de paiement soit toujours valide
3. Pour tout autre type paiement, le remboursement se fera par virement bancaire, sous réserve que les éléments suivants aient été communiqués :

- - Nom et coordonnées précises de la banque
  - Nom et coordonnées précises du détenteur du compte
  - IBAN, Swiftcode de la banque, et selon le pays, code ABA

Les frais de change éventuels sont à la charge du Participant ou de la société.

1. Aucun remboursement par chèque ou espèces ne sera possible, ni en France, ni à l’étranger.

14. OBLIGATIONS DU PARTICIPANT ET DE L’EXPOSANT

L’inscription à un Evènement auprès de UL PROPULS implique l’acceptation des conditions suivantes :

1. Chaque inscription est valable uniquement pour l’Evènement qui y est mentionné et ne pourra être acceptée pour un autre Evènement.
2. Le Participant se verra délivrer un badge d’accès lui permettant de participer à l’Evènement. Le badge d’accès est nominatif, non transférable et doit être porté pendant toute la durée de l’Evènement.
3. Le Participant ou l’Exposant s’engage à respecter les règles de vie et les consignes de sécurité générale en vigueur sur le site de l’Evènement. UL PROPULS se réserve le droit d’exclure toute personne ne respectant pas cet engagement.

15. PROPRIETE INTELLECTUELLE – DROIT A L’IMAGE

1. Les interventions des intervenants, ainsi que les documents diffusés ou remis lors de l’Evènement sont couverts par le droit d’auteur en application des articles L 111-1 et suivants du Code de la Propriété Intellectuelle. Aux termes de l’article L 122-4 du Code de la Propriété Intellectuelle « toute représentation ou reproduction intégrale ou partielle faite sans le consentement de l’auteur ou de ses ayants droit ou ayants-cause est illicite ». L’article L 122-5 de ce code n’autorise que« les copies ou reproductions strictement réservées à l’usage privé du copiste et non destinées à une utilisation collective » et « les analyses et courtes citations », « sous réserve que soient indiqués clairement le nom de l’auteur et la source ». Toute représentation ou reproduction non autorisée, par quelque procédé que ce soit, ne respectant pas la législation en vigueur constituerait une contrefaçon sanctionnée par les articles L 335-2 et L 335-3 du Code de la Propriété Intellectuelle. La responsabilité du Participant ou Exposant serait engagée si un usage non autorisé était fait des interventions, documents diffusés ou remis lors de l’Evénement.
2. Les propos tenus par les intervenants lors de l’Evènement le sont sous leur seule responsabilité. Il est de la responsabilité des Participants et des Exposants de vérifier la pertinence des opinions / recommandations formulées par les intervenants. UL PROPULS ne sera pas responsable, directement ou indirectement, pour tout dommage ou perte causée par ou en lien avec les informations diffusées ou les présentations effectuées lors de l’Evènement.
3. UL PROPULS se réserve le droit de citer le nom du Participant ou de l’Exposant, dans les documents destinés à la préparation ou à la promotion de l’Evènement.En cas d’opposition, le Participant ou l’Exposant devra en informer par écrit UL PROPULS dans les meilleurs délais à compter de la confirmation de son inscription à l’Evènement et en toute hypothèse au plus tard en date de l’Evènement.
4. L’inscription et la participation au Congrès implique l’acceptation par le Participant, ou l’Exposant d’être cité, photographié ou filmé à l’occasion du Congrès ou de sa préparation, ainsi que l’acceptation de l’utilisation à des fins commerciales ou non commerciales des photos et des films par UL PROPULS ou par un tiers autorisé par UL PROPULS.
5. Dans le cas d’une présentation orale, le Participant ou l’Exposant sera avisé lors de son arrivée de l’enregistrement vidéo et sonore de sa présentation et se verra remettre une demande d’autorisation de captation et d’exploitation de cet enregistrement. Le Participant ou l’Exposant est libre de donner ou non son consentement concernant l’utilisation de cet enregistrement.

16. CONFIDENTIALITE – INFORMATIQUE ET LIBERTES

1. Les informations recueillies lors de l’inscription font l’objet d’un traitement informatique destiné à assurer un meilleur suivi de l’inscription (notamment : envoi de documents relatifs à l’inscription et, le cas échéant, prise de contact en cas de modification d’un Evénement). UL PROPULS veille à ce que les données recueillies soient maintenues confidentielles. Elles ne sont pas communiquées à d’éventuels partenaires commerciaux ni à des tiers, Il est néanmoins possible de recevoir ultérieurement des annonces et informations concernant des congrès à venir, ainsi que des lettres d’informations semestrielles. Le Participant est libre, à tout moment, de se retirer de la liste de diffusion.
2. Conformément à la loi « Informatique et libertés » du 6 janvier 1978, modifiée en 2004, le Participant ou l’Exposant dispose d’un droit d’accès et de rectification aux informations qui le concernent, qu’il peut exercer en formulant une demande par e-mail à l’adresse events[@]ul-propuls.fr. Il peut également, pour des motifs légitimes, s’opposer au traitement des données le concernant en envoyant un e-mail à la même adresse

17. DONNÉES NOMINATIVES

1. Cadre réglementaire

Conformément à la loi Informatique et Libertés du 6 janvier 1978, et au Règlement Général sur la Protection des Données (Règlement UE 2016/679 du 27 avril 2016), UL PROPULS traite des données à caractère personnel de ses clients, ci-après mentionnées comme données Client.

1. Type de données collectées

Les données Clients collectés par UL PROPULS peuvent être les suivantes : nom, prénom, civilité, fonction ou statut, adresse email, date de naissance, adresse postale, numéro de téléphone, régime alimentaire, coordonnées complètes de sa société ou institution.

1. Finalités des traitements

Ces données Client sont collectées dans le cadre des activités de UL PROPULS de prestations scientifiques et technologiques en génie des procédés et dans le domaine des sites et sols pollués, ainsi que dans le cadre de l’organisation d’événements scientifiques.

1. Destinataires

Les destinataires des données sont le service communication de UL PROPULS, ainsi qu’un prestataire de paiement (SystemPay, solution de paiement de la Banque Populaire), la société assurant la maintenance du système (DMConcept), l’hébergeur du site https://ul-propuls.events/SFGP2024/ (OVH). Les transferts de données avec nos prestataires sont encadrés contractuellement et selon la loi en vigueur, et font l’objet d’un niveau de sécurité des données adéquat.

1. Conservation

Conformément au principe de conservation du Règlement Général sur la Protection des Données, et à la Norme simplifiée 48 pour la gestion des fichiers clients, les données à caractère personnel relatives aux clients ne peuvent être conservées au-delà de la durée de conservation strictement nécessaire à la gestion de la relation commerciale.

UL PROPULS s’engage à contacter le client au terme d’une durée de 3 ans, suivant le dernier Evènement où il s’est inscrit, pour lui demander s’il souhaite toujours être destinataire de nos informations. Sans réponse claire de sa part, UL PROPULS s’engage à archiver ses données.

Font exception les données nécessaires à l’établissement de la preuve d’un droit ou d’un contrat qui peuvent être archivés, comme prévu par les dispositions du Code de commerce relatives à la durée de conservation des livres et documents créés à l’occasion d’activités commerciales, et du Code de la consommation relatives à la conservation des contrats conclus par voie électronique.

1. Droits de la personne concernée

Le Client dispose d’un droit d’accès et de rectification des données le concernant, et peut également faire valoir son droit à l’effacement ou droit à l’oubli, ainsi que son droit d’opposition ou droit à la portabilité. Pour toute demande, il lui suffit d’écrire à UL PROPULS, 34, cours Léopold –54000 NANCY, contact[@]ul-propuls.fr

Enfin, tout Client a le droit d’introduire une réclamation devant l’autorité de contrôle compétente (en France, il s’agit de la CNIL) concernant le traitement de ses données personnelles.

1. Licéité des traitements

La fourniture des données Clients est nécessaire pour une inscription sur le site https://ul-propuls.events/SFGP2024/ en particulier pour l’édition des documents personnalisés (facture, badge, attestation de présence). Enfin, les traitements de données par UL PROPULS peuvent répondre à une obligation légale (fiscalité ou gestion des contentieux par exemple).

18. LITIGES

1. Les présentes conditions sont régies par la loi française.
2. Les présentes conditions générales de vente annulent et remplacent toutes les précédentes conditions générales dont la date est antérieure.
3. Dans l’hypothèse où l’une des dispositions des présentes serait considérée comme nulle en vertu d’une disposition légale ou réglementaire, présente ou future, ou d’une décision de justice revêtue de l’autorité de la chose jugée et émanant d’une juridiction ou d’un organisme compétent, cette disposition serait considérée comme étant non écrite, toutes les autres dispositions des conditions générales conservant force obligatoire entre les Parties.

2. SCOPE OF APPLICATION

2.1. TERMINOLOGY

The Participant is defined as any individual participating in his or her own name or on behalf of a legal entity (company, laboratory, corporation, or manufacturer) in an event organized by or with the logistical support of UL PROPULS. The Participant is required to attend conferences (physical or virtual), to take part in the various animations of the scientific and social program, but also to intervene within the framework of oral or poster communication according to the selected scientific program.

The Exhibitor is defined as any individual participating on behalf of a legal entity (company, laboratory, corporation, or manufacturer) as a stakeholder in an event organized by or with the logistical support of UL PROPULS. The modalities of this participation are detailed in a partnership file. For greater readability, regardless of the type of offer selected (financial support, partner, sponsors, grant, exhibitor), the generic term Exhibitor will be used hereafter in these terms and conditions.

The Event is defined as any event organized by or with the logistic support of UL PROPULS. These events can take different forms: seminar, technical day, summer school, congress, workshop, round table, or general assembly. An Event can take place in a manner that is physical, hybrid (physical and virtual), or virtual only.

2.2. SCOPE OF APPLICATION

The present terms and conditions, to the exclusion of any other provision, apply to the registration of one or more Participants for an Event organized by UL PROPULS, hereinafter referred to as the « Participant« , or to any participation by a stakeholder or Exhibitor in the form of a partnership, hereinafter referred to as the « Exhibitor« .

1. 1. Completion of online registration implies unreserved acceptance of these terms and conditions in their entirety.
  2. UL PROPULS reserves the right to modify the terms of the present conditions. Only the terms and conditions in effect on the day of registration will apply to the registration concerned.

3. REGISTRATION

3.1 FOR PARTICIPANTS

Registration as a Participant may be done online by completing the form available on the Event’s website.

3.2 FOR EXHIBITORS

Registration as an Exhibitor may be done either by completing the form directly online on the Event’s website, or by returning the reservation form by email to the dedicated email address of the congress secretariat or to events@ul-propuls.fr.

3.3 LATE REGISTRATION

A registration will be considered to be late if submitted less than 14 calendar days before the Event by a Participant and less than 45 days before the Event by an Exhibitor. Special conditions of payment apply to all late registrations, which are described below in article 4.5 Late registration payment.

4. TERMS OF PAYMENT

4.1 FOR PARTICIPANTS

Participant registration fees should be made payable to UL PROPULS in full without discount. Incomplete registration submissions or those not accompanied by full payment under the conditions specified below will not be considered.

4.2 FOR EXHIBITORS

Exhibitor registration fees should be made payable to UL PROPULS in full without discount. Incomplete registration submissions or those not accompanied by full payment under the conditions specified below will not be considered. The partnership, whatever its nature, is only confirmed valid upon receipt of payment from the Exhibitor by UL PROPULS. None of the compensatory measures proposed (for example, logo publication) will be allowed until the total payment has been made.

4.3 PAYMENT DEADLINE

Payments must be made no later than:

- - 14 calendar days before the event for a Participant
  - 45 calendar days before the event for an Exhibitor

To pay by bank transfer, please specify the name of the Event concerned, the name of the Participant or Exhibitor, a reference number for the order or invoice, in the bank references section. Please note that bank charges are the responsibility of the sender: please ensure that the payment includes all charges, including the receiving bank’s handling fee (« sender pays all charges »).

Checks should be made payable to UL PROPULS. Please include the following information on the back of the check: the name of the Event, the name of the Participant or Exhibitor and the order or invoice reference number.

To by pay credit card, simply follow the online instructions. Please note that it is important to select the payment by credit card option before completing the payment process.

UL PROPULS will accept only one method of payment per registration.

Once a payment has been made, a full refund will only be issued in cases specified in Articles 9, 10, 11 and 12 hereof.

4.5 LATE REGISTRATION

Late registration payment must reach UL PROPULS’s account (via payment by credit card, bank transfer or purchase order) within 7 working days following the reception by UL PROPULS of the registration.

5. REGISTRATION VALIDATION

Once the Participant has registered, UL PROPULS will send him/her a registration confirmation validating his/her registration for the chosen Event (the “Registration Confirmation”).

The contract is considered definitively concluded when UL PROPULS sends the Confirmation of Payment, subject to the correct collection of payment.

6. REGISTRATION FEES

Registration fees are per Participant and/or per Exhibitor, all taxes included (TTC). UL PROPULS reserves the right to modify its fees at any time. The applicable fees are those in effect at the time of registration (fees listed on the UL PROPULS website at the time of registration or listed on the registration form received by the Participant or Exhibitor). They include all services described on the dedicated Event registration website.

7. MODIFICATION OF THE EVENT PROGRAM

In case of necessity, and in particular in case of minor changes to the Event program (absence of one of the speakers, substitution of an invited speaker, scheduling changes), UL PROPULS reserves the right to modify programming for the Event in question without being held accountable for refunds or any other additional compensation for the Participant or the Exhibitor.

8. AVAILABILITY

UL PROPULS reserves the right to refuse a Participant his or her registration for the Event or for one of its options (evening reception, visit, lunch, etc.) if the reception capacities initially planned or amended by decision of the public authority are exceeded.

Similarly, UL PROPULS reserves the right to refuse an Exhibitory the right to participate in the Event if the reception capacities initially planned or amended by decision of the public authority are exceeded. This right also applies in case of unavailability of the proposed services (in particular in case of exclusivity pertaining to certain partnership offers).

In case of payment but unavailability of a place, UL PROPULS will inform the Participant or Exhibitor and reimburse the registration fee without penalty in accordance with the reimbursement terms described in Article 13.

9. REGISTRATION WITHDRAWL

The person or company registered as a Participant or Exhibitor has the right of withdrawal which can be exercised within 14 calendar days of online registration, without having to justify a reason. The Participant or Exhibitor who wishes to withdraw from registration must notify UL PROPULS within the legal deadlines indicated above by returning the standard form available below to the following address: UL PROPULS, 34, cours Léopold, 54000 Nancy, France, or by email to events[@]ul-propuls.fr. Upon receipt of this form, UL PROPULS will proceed with reimbursement according to the methods described in Article 13.

In the event that the 14-day withdrawal period mentioned above has expired and the Participant wishes to cancel his/her participation in the Event, he/she must inform UL PROPULS by email. UL PROPULS will then proceed with processing fee reimbursement in accordance with the conditions specified in Articles 10 and 13.

Participants submitting a request to withdraw their registration are asked to include with their registration withdrawal request a copy of the initial Registration Confirmation and a valid RIB (bank account details) to facilitate reimbursement of registration fees, according to terms of reimbursement defined in Article 13.

10. CANCELLATION BY THE PARTICIPANT OF EXHIBITOR

Notice of all cancellations must be submitted in writing (by mail or email). Cancellation fees are subject to the following conditions:

Cancellation of registration to the Event by the Participant

- - - Cancellation up to 45 calendar days before the event: 100% refund minus a 50€ administrative fee.
    - Cancellation between 45 and 22 calendar days before the event: 50% refund, with a minimum deduction of 50€.
    - Cancellation less than 21 calendar days before the event: no refunds will be issued except for withdrawal after the legal 14-day cancellation period mentioned in Article 9.

Cancellation of registration to the Event by the Exhibitor

- - - Cancellation up to 10 calendar weeks before the event: 30% refund of total registration fees.
    - Cancellation less than 10 calendar weeks before the event: no refund available.

Cancellation of a registration to the networking program or other social events by the Participant

- - - Cancellation up to 15 calendar days before the event: full order refund.
    - Cancellation less than 14 calendar days before the event: no refunds available, except for the legal 14-day cancellation period in accordance with Article 9.

If the conditions for reimbursement are met, UL PROPULS will process a refund for the amount due according to the methods described in Article 13.

11. CANCELLATION OR POSTPONEMENT OF THE EVENT

11.1 EVENT CANCELLATION

In the event that UL PROPULS is obliged to cancel the Event for reasons other than force majeure events* or circumstances beyond its control, UL PROPULS undertakes to inform the Participants and Exhibitors as soon as possible. The latter will then be reimbursed their registration fees in full, excluding all other expenses (accommodation, transport or other) in according to terms of reimbursement described in Article 13.

11.2 EVENT POSTPONEMENT

In the event that UL PROPULS is obliged to postpone the Event for reasons other than force majeure events* or circumstances beyond its control, UL PROPULS undertakes to notify the Participants, Exhibitors and accompanying persons as soon as possible.

By default, Participants’ and Exhibitors’ registrations are automatically maintained for the next edition.

Upon request by email, Participants may cancel their participation and at that time the terms and conditions set out in Article 10 shall apply.

*Force majeure events: a force majeure is a contractual provision which excuses one or both parties’ performance obligations when circumstances arise which are beyond the parties’ control and make performance of the contract impractical or impossible. For example: natural disasters (storm, hurricane), political events (war, terrorism), and other major unforeseen events such as fire, disease or epidemics.

12. CASE OF FORCE MAJEURE

In the event that the Event is postponed or cancelled due to force majeure as defined in Article 1218 of the French Civil Code as an event beyond the control of the affected party that could not reasonably have been foreseen at the time of the conclusion of the contract and whose effects could not be avoided by appropriate measures, the responsibility of UL PROPULS cannot be engaged and no reimbursement of registration fees or any other expenses (accommodation, transport or other) will be due.

13. REPAYMENT TERMS AND CONDITIONS

1. UL PROPULS will process the partial or total refund of registration fees described in the present terms and conditions within 14 calendar days upon receipt of the necessary elements allowing for the refund.
2. If the payment of the registration was made by credit card, applicable fees will be refunded by crediting this credit card provided that the payment card is still valid.
3. For any other type of payment, a refund will be issued by bank transfer, provided that the following elements have been communicated correctly:

– Name and precise contact details of the bank

– Account holder’s name and contact information

– IBAN, Swiftcode of the bank, and depending on the country, the ABA code

Additional fees associated with exchange rates will be the responsibility of the Participant or the company.

1. No refunds will be issued by check or cash, neither in France nor abroad.

14. OBLIGATIONS OF THE PARTICIPANT AND THE EXHIBITOR

Registration to an event hosted by UL PROPULS implies the acceptance of the following conditions:

1. 1. Each registration is valid only for the Event mentioned therein and will not apply to any other Event.
  2. The Participant will be issued with an access badge allowing him/her to participate in the Event. This badge is personal, non-transferable and must be worn for the duration of the Event.
  3. The Participant or Exhibitor undertakes to comply with the rules of life and general safety instructions in effect on the Event site. UL PROPULS reserves the right to exclude any person who does not respect this commitment.

15. INTELLECTUAL PROPERTY — IMAGE RIGHTS

1. All presentations made by speakers, as well as any documents diffused during the Event pertaining to their presentation are protected by copyright pursuant to Articles L 111-1 and in accordance with the French Intellectual Property Code. Pursuant to Article L 122-4 of the Intellectual Property Code « any representation or reproduction, in whole or in part, which is not expressly authorized, constitutes an infringement of intellectual property rights ». Pursuant to Article L 122-5 of the Intellectual Property Code, only « copies or reproductions strictly reserved for the private use of the copying party and not intended for collective use » and « analyses and short quotations », « provided that the author name and source be shown clearly”. Any unauthorized representation or reproduction, by any means whatsoever, that does not comply with current legislation constitutes an infringement punishable by Articles 335-2 and L 335-3 of the Intellectual Property Code. The Participant is solely responsible for any unauthorized use of presentations and documents diffused or distributed during the Event.
2. All comments and remarks made by the speakers during the Event are under their sole responsibility. It is the responsibility of the Participants and Exhibitors to verify the relevance of the opinions / recommendations made by the speakers. UL PROPULS shall not be liable, directly or indirectly, for any damage or loss caused by or in connection with the information disseminated or the presentations made during the Event.
3. UL PROPULS reserves the right to mention the name of the Participant or Exhibitor in the documents intended for the preparation or promotion of the Event. In case of opposition, the Participant or Exhibitor must inform UL PROPULS in writing as soon as possible after his/her registration to the Event has been confirmed and no later than the date of the Event.
4. Registration and participation in the Congress implies the acceptance by the Participant or Exhibitor to be quoted, photographed or filmed on the occasion of the Congress or its preparation, as well as the acceptance of the use for commercial or non-commercial purposes of the photographs and films by UL PROPULS or by a third party authorized by UL PROPULS.
5. In the case of oral presentation, the Participant or Exhibitor will be informed upon arrival that UL PROPULS may be required to record their presentation by video and sound, and they will be provided with an image release form authorizing the use by UL PROPULS of any and all photographs, video, voice recordings, or other media taken of Participants including derivative works thereof (collectively, the “Images”). Participants and Exhibitors are free to refuse consent concerning any and all use of images.

16. PRIVACY — DATA PROTECTION

1. All data pertaining to Participants and Exhibitors collected during the registration process is subject to computer processing to improve the registration process (specifically the transfer of documents related to registration and, if necessary, information to facilitate contacting Participants and Exhibitors to inform them of any modifications or cancellations of Events). For this purpose, UL PROPULS has submitted a declaration of intent with the French National Commission of Information and Technology and Liberties (CNIL), filed under registration number 19911175. UL PROPULS shall ensure that all collected data will be kept confidential and are not communicated to potential business partners or any external parties with the exception of use by UL PROPULS to inform past Participants and Exhibitors of announcements, information about upcoming Events and to disseminate semi-annual newsletters. Participants and Exhibitors are free, at any given time, to unsubscribe to the mailing list
2. In accordance with the Data Protection Act of 6 January 1978, amended in 2004, the Participant or Exhibitor retains the right to access and correct their personal data by sending a request by email to: events[@]ul-propuls.fr. The Participant or Exhibitor may also, for legitimate reasons, object to the processing of data relating to him/her by sending an email to the same address.

17. PERSONAL DATA

1. Regulatory framework

UL PROPULS processes all personal data of Participants and Exhibitors, hereinafter referred to as “Customer data”, in accordance with the French Data Protection Act of 6 January 1978 and the European General Data Protection Regulation (GDPR) (EU) Regulation 2016/679 of 27 April 2016.

1. The type of information we collect

Customer data collected by UL PROPULS may include the Participant’s or Exhibitor’s full name, title, function or status, email address, date of birth, complete mailing address, phone number, meal preferences and complete information pertaining to his/her company or institution.

1. How we use Customer data

Customer data are collected for the purposes of supporting and advancing UL PROPULS’s activities in scientific and technological services related to process engineering and the environment (contaminated sites and soils), as well as within the framework of the organization of scientific events.

1. Recipients

The parties who receive and process Customer data collected by UL PROPULS are those who work within the UL PROPULS communication department, payment service providers (Banque Populaire payment solutions), our computing system maintenance provider (DMConcept) and the UL PROPULS website (https://progep-conf.com) hosting provider (OVH). Data transfers between our service providers are contractually regulated, by law, and are subject to measures ensuring an adequate level of data security.

1. Storage

In accordance with the data conservation principles (time limits for data storage) of the European General Data Protection Regulation (GDPR)(EU) and on the basis of the standard simplified No.48 pertaining to the management of customer lists, data of a personal nature relating to the Client may not be stored beyond the period strictly necessary for the purpose of managing the commercial relationship.

UL PROPULS agrees to contact the Customer after a period of three years following the last event he/she attended to confirm if he/she wishes to continue to receive information from UL PROPULS. In the absence of response, UL PROPULS will archive all said Client data.

Exceptions are data necessary for establishing proof of copyright, or a contract that may be archived, as stipulated by the French Commercial Code and the French Consumer Code relating to contracts that are concluded electronically.

1. Rights of the person concerned

The Customer has the right to access and rectify data concerning him/her and may also exercise his/her right to obtain the deletion of personal data or the right to be forgotten, as well as the right to portability and the right to object. Requests for more information should be addressed to UL PROPULS, 34, cours Léopold— 54000 Nancy, France or by email to contact[@]ul-propuls.fr.

Lastly, every Customer has the right to lodge a complaint with a supervisory authority (in France, this is CNIL) concerning processing of his or her personal data.

1. Lawfulness of personal data processing

The provision of Customer data is necessary for a registration on this website, specifically for the purpose of printing personalized documents (invoices, name badges and proof of attendance). Finally, data processed by UL PROPULS may also serve certain legal requirements (for taxation documentation purposes or fiscal management).

18. CONFLICTS

1. The present Terms & Conditions are governed by French law.
2. These Terms & Conditions cancel and replace all previous terms and conditions.
3. In the event that one of the provisions hereof is considered invalid by virtue of a legal or regulatory provision, present or future, or a court decision with the authority of res judicata and emanating from a competent jurisdiction or body, this provision shall be considered unwritten, all other provisions of the general terms and conditions remaining binding before the Parties.
